Appraisal fee charged without appraisal? Sue For…?

Hello, my name is Joe. I am in the process of buying a house with an FHA loan. My mortgage broker, who is a good friend, was in the process of trying to get me approved for a loan. When he found out that the lender he was going with wouldn’t accept my school history as work history (even though FHA says otherwise) he canceled the loan appraisal and an appraisal was never done. However, the appraisers still took an appraisal fee ($445) out of my account without my consent even though an appraisal was never done.

What is the legal terminology for what I can sue for if it comes to that point? I am just trying to prepare myself in case they won’t refund my money.

Speak to the lender and tell them you want the money back. If s/he doesn’t respond, ask to speak to a superior. In general, suing would be pointless considering you’ll pay significantly more for a lawyer and the lawsuit than what you’re getting back. I know the principle of the matter is that you should not have been charged $445 for something that never took place, but I’d try other avenues before suing.
